Turkey (dec.) - 65899/01 Decision 11.9.2001 [Section I] Article 2 Article 2-1 Life Disappearance: admissible The applicants are relatives of the President and the Secretary of the People's Democracy Party of Silopi, of whom they have been without news since their attendance at the gendarmerie in January 2001. The applicants lodged a complaint with the Silopi Public Prosecutor at the end of January 2001. The Turkish Government say that in February 2001, at the request of the prosecutor in charge of the investigation, the district-court judge issued an injunction restricting access to the preliminary investigation file. Referring to that injunction, they have not produced the evidence in the investigation file. Admissible under Articles 2, 3, 5 and 13: preliminary objection (non-exhaustion) – the Government have not produced copies of the documents from the case file relating to the investigation instituted by the Silopi Public Prosecutor in the instant case.
