BOSNIA AND HERZEGOVINA   The European Court of Human Rights is holding a Chamber hearing today Tuesday 28 June 2005 at 9.30 a.m., on the admissibility and merits in the case of Jeličić v. Bosnia and Herzegovina (application no. 41183/02).   The applicant   The applicant, Ruža Jeličić, is a national of Bosnia and Herzegovina who was born in 1953 and lives in Banja Luka, Bosnia and Herzegovina.   Summary of the facts   On 31 January 1983 she placed a sum of money in German marks (DEM) in two foreign-currency savings accounts at the former Privredna banka Sarajevo Filijala Banja Luka (the present-day Nova banjalučka banka ). Foreign-currency savings which were deposited prior to the dissolution of the former Socialist Federal Republic of Yugoslavia (“old” foreign-currency savings) fall under a special legal regime in Bosnia and Herzegovina.   The applicant attempted unsuccessfully to withdraw her savings from the bank on several occasions.   On 26 November 1998 she obtained a judgment ordering her bank to release all sums on her accounts plus default interest and legal costs. Since that judgment was not executed, on 12 January 2000 the Bosnia and Herzegovina Human Rights Chamber found that the Republika Srpska (part of Bosnia and Herzegovina in which the bank is situated) had violated the applicant’s rights under the European Convention on Human Rights and ordered the Republika Srpska to enforce the judgment without further delay. However, the judgment has not yet been enforced.   On 18 January 2002, according to domestic legislation and following the completion of the privatisation of the bank, the money in the applicant’s foreign-currency accounts became a public debt attributable to the Republika Srpska.   Complaints   The applicant complains that she could not withdraw her foreign-currency savings and also about the non-enforcement of the original judgment and the decision of the Human Rights Chamber. She relies on Article 1 of Protocol No. 1 to the European Convention on Human Rights (protection of property).   Procedure   The application was lodged with the European Court of Human Rights on 19 August 2002.   Composition of the Court   The case will be heard by a Chamber composed as follows:   Nicolas Bratza (British), President , Josep Casadevall (Andorran), Matti Pellonpää (Finnish), Rait Maruste (Estonian), Kristaq Traja (Albanian), Ljiljana Mijović (citizen of Bosnia and Herzegovina), Ján Šikuta (Slovakian), judges , Giovanni Bonello (Maltese), Stanislav Pavlovschi (Moldovan), Javier Borrego Borrego (Spanish), substitute judges , and also Michael O’Boyle , Section Registrar .   Representatives of the parties   Government :   Zikreta Ibrahimović , Agent ,   Monika Mijić , Counsel ;   Applicant :   Predrag Radulović , Counsel,   Svetozar Nišić , Adviser .   The applicant, Ruža Jeličić, will also be present at the hearing.     ***   After the hearing the Court will begin its deliberations, which are held in private. Since 1 November 1998 it has sat as a full-time Court composed of an equal number of judges to that of the States party to the Convention. The Court examines the admissibility and merits of applications submitted to it. It sits in Chambers of 7 judges or, in exceptional cases, as a Grand Chamber of 17 judges. The Committee of Ministers of the Council of Europe supervises the execution of the Court’s judgments.
