Italy (application no. 10427/02) The applicants, Daniela Roda and Matteo Bonfatti, are Italian nationals who were born in 1962 and 1979 respectively and live in Finale Emilia and Massa Finalese. They are also acting on behalf of S.B., who is Ms Roda’s daughter and Mr Bonfatti’s sister, was born in 1988 and lives in Mirandola.   The application concerns the decision to take S.B. into public care in 1998 on account of presumptions that the child had been sexually abused by members of the applicants’ family.   The applicants complain, in particular, of a violation of Article 8 (right to respect for private and family life) of the European Convention on Human Rights on account of the removal of S.B. from the family home and their lack of any contact with the child for almost four years.   Demir and Baykara v. Turkey (no. 34503/97) The applicants, Kemal Demir and Vicdan Baykara, are Turkish nationals who were born in 1951 and 1958 respectively. Mr Demir lives in Gaziantep and Ms Baykara in Istanbul. At the material time Mr Demir was a member of the Tüm Bel Sen trade union and Ms Baykara was its president.   Founded in 1990 by officials from various local authorities, Tüm Bel Sen pursued the aim, as set out in its constitution, of promoting democratic trade unionism in order to assist its members to realise their aspirations and demands.   The case concerns the finding by the Court of Cassation that the Tüm Bel Sen trade union had no legal personality, and the annulment of the collective agreement between the union and Gaziantep District Council.   The applicants complain under Articles 11 (freedom of assembly and association) and 14 (prohibition of discrimination) that the Turkish authorities infringed their right to form trade unions and to reach collective agreements.   ***   Press contacts Emma Hellyer (telephone: 00 33 (0)3 90 21 42 15) Stéphanie Klein (telephone: 00 33 (0)3 88 41 21 54) Beverley Jacobs (telephone: 00 33 (0)3 90 21 54 21)   The European Court of Human Rights was set up in Strasbourg by the Council of Europe Member States in 1959 to deal with alleged violations of the 1950 European Convention on Human Rights.Citations
