Poland   28 April 2008   The European Court of Human Rights will be notifying in writing a Grand Chamber judgment in the pilot case, Hutten-Czapska v. Poland (application no. 35014/97), on Monday 28 April 2008, which deals with the question of pecuniary damage, under Article 41 (just satisfaction) of the European Convention on Human Rights.   In its principal judgment in the case (19 June 2006) the Grand Chamber held that there had been a violation of Article 1 of Protocol No. 1 (protection of property) to the Convention concerning the fact that the applicant could not use her property or charge adequate rent for its lease. The Grand Chamber found that the violation was part of a systemic problem, the malfunctioning of Polish housing legislation.
