He complains principally that, notwithstanding assurances to the contrary from the Jordanian Government, if deported to that country he is at real risk of being subjected to ill-treatment in breach of Article 3 (prohibition of torture and inhuman and degrading treatment) of the European Convention on Human Rights and flagrant breaches of Articles 5 (right to liberty and security) and 6 (right to a fair trial) of   the Convention.   On 18 February 2009 Mr Othman sought interim measures under Rule 39 of the Rules of Court to prevent his deportation to Jordan while the Court considered his application.
