Poland (application no. 2815/05) Kulikowski v. Poland (no. 18353/03) The applicants, Radosław Antonicelli and Adam Kulikowski, are Polish nationals who were born in 1974 and 1964, respectively. They are both currently in prison: Mr   Antonicelli is serving a 15-year sentence for manslaughter; and, Mr   Kulikowski a 12-year sentence for murder. Relying in particular on Article   6   §§   1 and   3   (c) (right to a fair trial) of the European Convention on Human Rights, both applicants complain that they were denied effective access to the Supreme Court as their legal-aid lawyers had refused to draft a cassation appeal in their cases. Mr   Kulikowski also complains about his detention pending trial, namely that it had exceeded a “reasonable time” and that, during that period, contact with his children had been restricted. He further relies on Article   5   §   3 (right to liberty and security) and Article   8 (right to respect for private and family life and correspondence) of the Convention.   Stojanović v. Serbia (no. 34425/04) The applicant, Ljubiša Stojanović, is a Serbian national who was born in 1956. The case concerns Mr   Stojanović’s complaint that, while serving a prison sentence, the authorities refused to provide him with free dentures. He also complains that the prison authorities opened his correspondence with domestic bodies and the European Court. He relies on Articles   3 (prohibition of inhuman or degrading treatment),   8 (right to respect for correspondence) and Article   1 of Protocol No.   12 (general prohibition of discrimination).     ***   Press contacts Stefano Piedimonte (telephone : 00 33 (0)3 90 21 42 04) Tracey Turner-Tretz (telephone : 00 33 (0)3 88 41 35 30) Paramy Chanthalangsy (telephone : 00 33 (0)3 88 41 28 30) Kristina Pencheva-Malinowski (telephone : 00 33 (0)3 88 41 35 70) Céline Menu-Lange (telephone : 00 33 (0)3 90 21 58 77)   The European Court of Human Rights was set up in Strasbourg by the Council of Europe Member States in 1959 to deal with alleged violations of the 1950 European Convention on Human Rights.Citations
