BULGARIA and MITEV v. BULGARIA   The European Court of Human Rights is holding a Chamber hearing today Tuesday 10 November 2009 at 9 a.m. on the admissibility and merits in the cases of Stanev v. Bulgaria (application no. 36760/06) and Mitev v. Bulgaria (application no. 49151/07).   The hearing will be broadcast from 2.30 p.m. on the Court’s Internet site ( http://www.echr.coe.int ).   The two cases concern applications brought by two Bulgarian nationals, Roussi Stanev, who was born in 1956 and lives in Pastra (Bulgaria), and Mr Dimitar Ivanov Mitev, who was born in 1944. Mr Mitev died on 5   September 2008, after having applied to the Court. His sister, Ms Jordanka Hummel, expressed her wish to pursue the proceedings before the Court. By court orders and at the request of certain members of their respective families, the first applicant was placed under trusteeship, the second under guardianship. Both were subsequently placed in social care homes for individuals with psychiatric problems, Mr Stanev in the Pastra care home and Mr Mitev in a care home in Pravda. They requested the lifting of the measures imposed on them, but without success. Under Article 3 (prohibition of inhuman and degrading treatment) of the European Convention on Human Rights, Mr Stanev complains about the living conditions in the Pastra care home. Both applicants rely on Article 5 §§ 1, 4 and 5 (right to liberty and security) in complaining of an unlawful and arbitrary deprivation of liberty on account of their placement in care homes against their will, the impossibility under Bulgarian law of having the lawfulness of those measures examined and the absence of a judicial procedure to seek compensation. Relying on Article 6 (right to a fair hearing) they further complain that they did not have access to a court to request the restoration of their legal capacity. Under Article 8 (right to respect for private and family life) they complain about the trusteeship and guardianship systems and allege that those measures were not subject to any periodic review. Finally, they complain that no effective remedy exists under Bulgarian law to complain of the alleged violations, as required by Article 13 (right to an effective remedy).   The two applications were lodged with the European Court of Human Rights on 8 September 2006 and 19 September 2007 respectively.   The cases will be heard by a Chamber composed as follows:   Peer Lorenzen (Denmark), President , Renate Jaeger (Germany), Karel Jungwiert (Czech Republic), Rait Maruste (Estonia), Isabelle Berro-Lefèvre (Monaco), Mirjana Lazarova Trajkovska (“the former Yugoslav Republic of Macedonia”), Zdravka Kalaydjieva (Bulgaria), judges , Mark Villiger (Liechtenstein), substitute judge , and also Claudia Westerdiek , Section Registrar .     Representatives of the parties:   Government :   Nina Nikolova , Agent ,   Raya Nikolova, Agent ;   Applicants :   Aneta Genova , Victoria Lee , Jan Fiala , Counsel .   Rousi Stanev will also attend the hearing.   ***   After the hearing the Court will begin its deliberations, which are held in private.
