Iceland (application no. 20161/06) The applicant, Vörður Ólafsson, is an Icelandic national who was born in 1961 and lives in Reykjavik. An employer in the building sector and a member of the Master Builders’ Association, Mr Ólafsson complains about a statutory obligation to make a contribution to the Federation of Icelandic Industries, of which neither he nor the Association were a member. He relies on Articles 9 (freedom of thought, conscience and religion), 10 (freedom of expression), 11 (freedom of assembly and association) and   14 (prohibition of discrimination) as well as Article   1 of Protocol No.   1 (protection of property) to the European Convention on Human Rights.   Moretti and Benedetti v. Italy (no. 16318/07) The applicants, Luigi Moretti and his wife, Maria Brunella Benedetti, are Italian nationals who were born in 1966 and 1959 respectively and live in Lugo di Ravenna (Italy). In May 2004 a newborn baby was provisionally placed in their care by a court decision. They subsequently sought to adopt the child, but another family was chosen for her. Relying on Article   8 (right to respect for private and family life), the applicants complain that the relevant law and procedural rules were incorrectly applied regarding their request to adopt. Relying, further, on Article 6 § 1 (right to a fair hearing), they claim that the proceedings were unfair.   Ciubotaru v. Moldova (no. 27138/04) The applicant, Mihai Ciubotaru, is a Moldovan national who was born in 1952 and lives in Chişinău. He is a writer and French professor. The case concerns the Moldovan authorities’ refusal to alter his ethnicity on his identity papers, namely from Moldovan to Romanian. He relies on Article 8 (right to respect for private and family life) and Article 6 § 1 (right to a fair hearing).   Biełaj v. Poland (no. 43643/04) The applicant, Jurij Biełaj, is a Ukrainian national who was born in 1965 and lives in Kyiv. Mr   Biełaj complains about the unfairness of criminal proceedings brought against him for armed robbery, notably that he was not able to question two witnesses whose statements were used as the basis for his conviction. He relies on Article   6   §§   1 and   3 (right to a fair trial).   Friedensberg v. Poland (no. 44025/08) The applicant, Robert Friedensberg, is a Polish national who was born in 1971 and lives in Krasnystaw (Poland). The case concerns Mr Friedensberg’s complaint about censorship of his correspondence during his detention with regard to different sets of criminal proceedings against him, including robbery. He relies on Article   8 (right to respect for correspondence).   Polanowski v. Poland (no. 16381/05) The applicant, Stanisław Polanowski, is a Polish national who was born in 1962 and lives in Rzeszów (Poland). In December 2002 Mr Polanowski was arrested following a drunken fight with his wife and taken to a sobering-up centre. Relying in particular on Article   3 (prohibition of inhuman or degrading treatment), he alleges that he was ill-treated by the police during his arrest and that the investigation into his allegations was ineffective.   Weber and Others v. Poland (no. 23039/02) The applicants, Izabela Weber and her husband, Jan Weber, and their children, Mieczysław Weber and Janina Wajda, are Polish nationals who were born in 1928, 1918, 1949 and 1945 respectively and live in Stary Sącz (Poland). In 1999 their son and brother died in his flat in suspicious circumstances. Relying on Article   2 (right to life), the applicants complain of the lack of an effective, prompt and expeditious investigation which would have enabled them to determine the cause of their relative’s death and dispel the doubts regarding the circumstances surrounding it.   Hudáková and Others v. Slovakia (no. 23083/05) The applicants are three Slovakian nationals: Helena Hudáková who lives in Košice; Lea Bessenyeyová who lives in Malý Ruskov and Martin Sabó who lives in Milhosťov (Slovakia). They were born in 1956, 1977 and 1954 respectively. Relying on Article 6 § 1 (right to a fair hearing) and Article 1 of Protocol No. 1 (protection of property), the applicants complain about the unfairness of civil proceedings regarding a property dispute, in particular that on appeal written observations submitted by the plaintiffs were not communicated to them.     Thursday 29 April 2010   Khristoforov v. Russia (no. 11336/06) The applicant, Vladimir Khristoforov, is a Russian national who was born in 1961 and is currently serving a prison sentence in the Magadan Region (Russia) for manslaughter. Relying on Article   3 (prohibition of inhuman or degrading treatment), he alleges that the conditions of his detention pending investigation and trial between January and August   2005 were appalling.   Tugarinov v. Russia (no. 20455/04) The applicant, Vitaliy Tugarinov, is a Russian national who was born in Ivolginsk (Republic of Buryatiya, Russia). Relying on Article   6   §   1 (right to a fair trial within a reasonable time) and Article   13 (right to an effective remedy), Mr Tugarinov complains about the excessive length of criminal proceedings brought against him for disorderly conduct and causing severe injury.   Yuriy Yakovlev v. Russia (no. 5453/08) The applicant, Yuriy Yakovlev, is a Russian national who was born in 1951 and, formerly a senior official of the Federal Health Insurance Fund, lived in Moscow until his arrest in July   2007 on charges of aggravated bribery and abuse of position. He was convicted as charged in August 2009 and sentenced to nine years’ imprisonment and a fine. Relying in particular on Article   5   § 3 (right to liberty and security), he complains about the excessive length of his pre-trial detention.     Repetitive case   The following case raises an issue which has already been submitted to the Court.   Smetanko v. Russia (no. 6239/04) This case concerns the applicant’s complaint that the domestic authorities failed to enforce a final judgment in his favour in good time.
