Germany (application no. 19359/04)   COURT’S JUDGMENT CONCERNING RETROACTIVE EXTENSION OF A PRISONER’S PREVENTIVE DETENTION BECOMES FINAL   The five-judge panel of the Grand Chamber, meeting on 10 May 2010, rejected the referral request relating to the case of M. v. Germany submitted by the German Government on 16 March 2010. The Court’s Chamber judgment of 17 December 2009 has thereby become final (Article 44 of the European Convention on Human Rights).   The case concerned the preventive detention ( Sicherungsverwahrung ) of a convicted prisoner, deemed to be dangerous to the public by expert reports, which was extended retrospectively beyond the maximum period of ten years permissible for this form of detention at the time of his conviction. In its Chamber judgment of 17 December 2009, the Court unanimously found that there had been a violation of Article 5 § 1 (right to liberty) and Article 7 § 1 (no punishment without law) of the Convention. At the same time, the Court confirmed that the applicant's preventive detention before expiry of the ten-year-period was covered by Article 5 § 1.
