RUSSIA   Tuesday 18 September 2001 at 9 a.m.     The applicant   The case concerns an application brought by a Russian national, Valeriy Yermilovich Kalashnikov, who was born in 1955 and lives in Moscow, Russia.     Summary of the facts   In February 1995 the applicant, who was then president of the Northeast Commercial Bank ( Северо-Восточный Акционерный Банк ), was charged with embezzlement. In June 1995 he was placed in detention on remand. Examination of his case by the Magadan City Court started in November 1996, but was adjourned from May 1997 to April 1999. He was convicted on 3 August 1999 and his appeals were rejected by the Supreme Court.     Complaints   The applicant complains that the length of his detention on remand and of the criminal proceedings against him violated his rights guaranteed under Articles 5 § 3 (right to be brought promptly before a judge) and 6 § 1 (right to a fair hearing within a reasonable time) of the European Convention on Human Rights. He also complains about the conditions of his detention, under Article 3 (prohibition of inhuman or degrading treatment), and of a lack of adequate contact with his family while in detention, contrary to Article 8 (right to respect for private and family life). He alleges under Article 6 § 1 that he did not have a fair trial by an impartial tribunal and, under Article 7 (no punishment without law), that the trial court applied criminal law retroactively. He further complains about the rejection of his appeals by the Supreme Court, relying on Article 13 (right to an effective remedy) and Article 2 of Protocol No.7 (right of appeal in criminal matters).     Procedure   The application was lodged with the European Court of Human Rights on 1 December 1998 and, on 15 May 2001, the Third Section of the Court decided to hold an oral hearing on the admissibility and merits of the case.     Composition of the Court   The case will be heard by a Chamber of seven judges composed as follows:   Jean-Paul Costa (French), President , Willi Fuhrmann (Austrian), Loukis Loucaides (Cypriot), Nicolas Bratza (British), Hanne Sophie Greve (Norwegian), Kristaq Traja (Albanian), Anatoly Kovler (Russian), judges , Pranas Kūris (Lithuanian), Françoise Tulkens (Belgian), Karel Jungwiert (Czech), Mindia Ugrekhelidze (Georgian), substitute judges ,   and also Sally Dollé , Section Registrar .     Representatives of the parties   Government:   Pavel Laptev , Representative of the Russian Federation at the Court ,   Yuri Berestnev , Sergey Volkovsky , Stanislav Razumov , Yury Kalinin , Advisers, Kamil Bahtiarov , Oleg Ankudinov , Vasiliy Vlasihin , Experts ;   Applicant:   Karinna Moskalenko and Naum Sonkin , Counsel .     The applicant, Mr Kalashnikov, will also attend the hearing.   ***   After the hearing the Court will begin its deliberations, which are held in private.
