GREECE   Thursday 20 September 2001 at 2.30 p.m.     The applicants   The case concerns an application brought by ten Turkish nationals, Fatma Ayten Yagtzilar, Mustafa Aykut Yagtzilar, Yakut Yagtzilar, Nermin Baykal, Bahadir Atik, Feriha Neriman Atik, Alan Hosman, Mukaddes Saraçoğlu, Rikkat Karaoğlu and Kenan Haciosmanoğlu. The applicants were born between 1913 and 1961 and live in Istanbul, Izmir (Mukaddes Saraçoğlu) and Antalya (Rikkat Karaoğlu).   Summary of the facts   The case concerns the occupation of an olive grove by the Greek State in 1925 for the benefit of refugees from Asia Minor. The applicants are the beneficiaries of the former owners of the olive grove, which was not formally expropriated until 1933. Compensation proceedings began on 8 December 1933. They ended on 15 July 1997 with a judgment in which the Court of Cassation upheld the decision of the Court of Appeal, which had held that the applicants’ entitlement to compensation was time-barred.   Complaints   Relying on Article 6 § 1 of the European Convention on Human rights (right to a fair trial), the applicants complain that they did not have a fair hearing and that the Greek courts, in finding that their entitlement to compensation was time-barred, had in fact deprived them of the right of access to a court. Relying on the same provision, the applicants further complain of the length of the proceedings. Lastly, they complain of an infringement of their right to peaceful enjoyment of their possessions, guaranteed by Article 1 of Protocol No. 1 to the Convention (protection of property).   Procedure   The application was lodged with the European Commission of Human Rights on 15 Januray 1998 and on 1 November 1998 the case fell to be examined by the European Court of Human Rights.
