FRANCE   The European Court of Human Rights (First Section) has considered the admissibility of the application (no. 54210/00) lodged on 14 January 2000 by Maurice Papon, which concerned the criminal proceedings that led to his conviction by an assize court. The Court declared admissible Mr Papon’s complaint that he did not have access to the Court of Cassation as a result of having forfeited his right to appeal to that court on points of law and that it was not possible to appeal against the conviction and sentence (in the meantime, by an Act of 15 June 2000, the provision in France’s Code of Criminal Procedure pursuant to which the right of appeal on points of law was forfeited has been repealed, and provision has been made for a right of appeal from assize courts). If the parties do not reach a friendly settlement, the Court will give judgment on the merits of these two complaints.   The Court declared Mr Papon’s other complaints inadmissible; they related principally to the length and fairness of the proceedings and an alleged breach of the principle of presumption of innocence and the principle that criminal legislation should not have retrospective effect.
