POLAND   11 June 2002 at 9.30 a.m.   The applicant   Zbigniew Pasławski is a Polish national, born in 1955. He is a farmer and lives in Ustrzyki Dolne, Poland.   Summary of the facts   On 28 February 1996 he bought 3.71 hectares of land near Bieszczadzki National Park in the Ustrzyki Dolne County. He fenced in the property and planted 15,000 spruce trees, aiming to sell them later as Christmas trees. However, during the winter of 1996/97 about 80% of the trees were damaged by game. The applicant estimates his loss at 47,800 Polish Zlotys. He replaced the destroyed trees but, in spring 1997, trees were again damaged by game.   On several occasions, the applicant found hunters trespassing on his property. It emerged that his land had been leased by the authorities to the local hunting club and that hunters were therefore free to hunt on his land without his prior consent. Moreover, he did not have the right to hunt on his property.   Subsequently, the applicant complained to Krosno Regional Office ( Urząd Wojewódzki w Krośnie ), Krosno Regional Directorate of Sate Forests ( Regionalna Dyrekcja Lasów Państwowych w Krośnie ), the Ombudsman and the local hunting club which leased his property. In April 1996 Krosno Regional Office informed him that he could not obtain compensation.   Complaint   The applicant complains: that although game on his land belongs to the State, it is not liable for any damage caused; that the State has increased the number of game on his land because it ‑   together with local hunting clubs ‑ derives profits from hunting; and, that he has no right to compensation for damage caused by game and hunters. He also complains about the compulsory transfer to the local hunting club of hunting rights over his land. He relies on Article 1 of Protocol N° 1 to the European Convention on Human Rights (protection of property).   Procedure   The application was lodged with the European Commission of Human Rights on 27 August 1997 and transferred to the Court on 1 November 1998.
