SPAIN   Tuesday 25 June 2002 at 9.30 a.m.     The applicant   The case concerns an application brought by a Spanish national, Maria Del Carme Cañete de Goñi, who was born in 1950 and lives in Jerez.     Summary of the facts   The applicant is a history and geography teacher. She passed a competitive examination and obtained a post as a certified teacher. However, following an application by some unsuccessful candidates, the Andalusia High Court gave judgment on 31 March 1995 declaring the competitive examination null and void, whereupon the applicant lost her post. She lodged an amparo appeal with the Constitutional Court, complaining that the Andalusia High Court had not summoned her to appear as a third party having an interest in the proceedings. In a judgment of 14 September 1999 the Constitutional Court dismissed her appeal. It held that the applicant had learned of the proceedings from non-judicial sources so that the failure to summon her to appear did not infringe Article 24 of the Constitution (right to a fair trial).   Complaint   The applicant complains, under Article 6 § 1 of the European Convention on Human Rights, that she did not have a fair trial because she was not summoned to appear and give evidence in her capacity as an interested party in the proceedings before the Andalusia High Court. This was particularly unfair, she argued, in that the outcome of those proceedings had caused her undeniable damage, namely the loss of her teaching post.   Procedure   The application was lodged on 4 February 2000 and declared admissible on 15 January 2002.           Composition of the Court   The case will be heard by a Chamber composed as follows:   Matti Pellonpää (Finnish), President , Antonio Pastor Ridruejo (Spanish), Elisabeth Palm (Swedish), Viera Strážnická (Slovakian), Marc Fischbach (Luxemburger), Josep Casadevall (Andorran), Stanislav Pavlovschi (Moldovan), judges, Rait Maruste (Estonian), substitute judge ,   and also Michael O’Boyle , Section Registrar .     Representatives of the parties   Government:     Javier Borrego Borrego, Agent ,   Applicant:     Antonio de la Plaza Zenni , Counsel .     ***   After the hearing the Court will begin its deliberations, which are held in private.
