Bulgaria (application no. 40061/98)     Friendly settlement M.S., a Bulgarian national, was born in 1953 and lives in Gabrovo.   On 28 June 1996 she was arrested upon the order of a prosecutor, brought to a psychiatric clinic for an examination, detained for five days and then released. She was again detained for a psychiatric examination on 28 August 1996. On 21 March 1997 the applicant was arrested, detained for a third time and brought to a psychiatric clinic where she was detained allegedly incommunicado until 4 April 1997.   Following a complaint by the applicant, the district health authorities informed her by letter of 28   March 1997 that her detention had been ordered by a prosecutor in accordance with the law. The applicant allegedly submitted another complaint to the Ministry of Health on 25 April 1997 but never received an answer.   The applicant complained, in particular, that her detention in a psychiatric clinic had been unlawful and arbitrary, relying on Article 5 (right to liberty and security) of the European Convention on Human Rights.   The case has been struck out following a friendly settlement in which 3,500 Bulgarian levs is to be paid for any non-pecuniary damage, costs and expenses. Croatia (no. 45435/99)   Friendly settlement In 1992 one of the applicants, Gojko Mikecin, a Croatian national, lent various sums of money to a number of companies at a high rate of interest (so-called financial engineering). As these companies failed to repay the loans, he instituted three different sets of proceedings in the Zagreb Municipal Court for re-payment of his loans.   The applicants complained under Article 6 § 1 (right to a determination of civil rights within a reasonable time) about the length of the civil proceedings. They also complained under Article 13 that they had no effective remedy at their disposal in respect of the length of these proceedings.   The case has been struck out following a friendly settlement in which 3,500 euros is to be paid for any non-pecuniary damage, costs and expenses.
