He also referred in his application to Article 2 (the right to life), Article 3 (prohibition of torture and inhuman or degrading treatment) and Article 6 §1 (the right to a fair trial).   The Chamber was of the opinion that it was not appropriate to apply Rule 39 at this stage. In view of the gravity of the allegations, however, it decided, under Rule 54 § 3 (a), to seek clarification from the Turkish authorities on a number of points concerning the circumstances of Mr Öcalan’s arrest and detention.
