TURKEY (application no. 27244/95) and TEKDAĞ v. TURKEY (application no. 27699/95)     A delegation of three Judges of the European Court of Human Rights (Second Section of the Court), composed of András Baka (Hungarian), Peer Lorenzen (Danish) and Marc Fischbach (Luxembourg) will be taking evidence from witnesses in Ankara (Turkey) from Monday 9 to Thursday 12 October 2000 in the Tepe case and from Thursday 12 (afternoon) to Friday 23 October 2000 in the Tekdağ case.   The Tepe v. Turkey application was introduced before the European Commission of Human Rights on 28 March 1995 and declared admissible on 25 November 1996. The applicant, Ishak Tepe, complained about the kidnapping followed by the killing of his son by unknown persons, allegedly State agents, in South-Eastern Turkey. The applicant also complained that the torture and killing of his son, a journalist, was designed to deter the lawful exercise of freedom of expression. He complained lastly that he had not had an effective remedy to complain of the breaches of which his son had been a victim, and alleged that the administrative and judicial authorities had failed to take appropriate steps in response to his complaints. The applicant alleged violations of Articles 2, 3, 5, 10, 13, 14 and 18 of the Convention.   The Turkish Government submitted that the applicant had not used the remedies provided for in Turkish legislation. They also denied that the applicant’s son had been in custody and alleged that his death was the result of a dispute within the PKK.   The Tekdağ v. Turkey application was introduced before the Commission on 12 May 1995 and declared admissible on 25 November 1996. The applicant, Hatice Tekdağ, complained that her husband had been kidnapped by plainclothes policemen while he was walking in the street and that he had probably been killed by State agents. She also complained of the lack of any independent national authority before which she could bring her complaints with any prospects of success.   The applicant alleged violations of Articles 2, 3, 5, 13 and 14 of the Convention.   The Turkish Government denied that the applicant’s husband had been detained and asserted that the applicant had not submitted any specific or plausible evidence in support of her allegations.
