Until 1988 the applicant operated the open-air cinema “Ilioupolis” in the Athens suburb of the same name.   Summary of the facts     The cinema “Ilioupolis” was built on a plot of land the ownership of which is in dispute between the heirs of K.N. and the State. The applicant leased the cinema from the heirs of K.N in 1978. In 1988 the authorities evicted the applicant from the cinema on the ground that he had been withholding State property unlawfully and assigned it to the Ilioupolis municipality. In 1989 the Athens Court of First Instance quashed the eviction order. The competent authorities of the Ministry of Finance, the State Legal Council and the State Lands Authority ruled that the Minister of Finance had to return the cinema to the applicant, but until now the Minister has refused to comply with the judgment of the Athens First Instance Court.   Complaints     The applicant complains that the failure of the authorities to return the cinema to him constitutes a violation of his right to property under Article 1 of Protocol No. 1 and his right to respect for his home under Article 8 of the Convention. He also alleges a violation of Articles 6 and 13 of the Convention because the authorities refuse to comply with the decision issued by the Athens First Instance Court in his favour.   Procedure     The application was lodged with the European Commission of Human Rights on 28 March 1996. Having found the application admissible the Commission adopted a report on 16 April 1998 in which it expressed the opinion that there had been a violation of Article 1 of Protocol No. 1 and of Article 13 of the Convention (14 votes to 1) and that it was not necessary to examine the complaints under Articles 6 and 8 of the Convention (unanimously). The case was referred to the Court by the Greek Government. Composition of the Court     Under the transitional provisions of Protocol No. 11 to the Convention the case was transmitted to the Grand Chamber of the European Court of Human Rights on the entry into force of the Protocol on 1 November 1998. It will be heard by the Grand Chamber composed as follows:   Elisabeth Palm   (Swedish), President, Luigi Ferrari Bravo   (Italian), Gaukur Jörundsson   (Icelandic), Lucius Caflisch   (Swiss), Ireneu Cabral Barreto   (Portuguese), Jean-Paul Costa   (French), Willi Fuhrmann   (Austrian), Karel Jungwiert   (Czech), Marc Fischbach   (Luxemburger), Nina Vajić   (Croatian), John Hedigan   (Irish), Wilhelmina Thomassen   ( Dutch), Margarita Tsatsa-Nikolovska   (FRYOMacedonia), Tudor Pantiru     (Moldovan), Egils Levits   (Latvian), Kristaq Traja   (Albanian), judges, Christos Geraris   (Greek), ad hoc judge, Boštjan Zupančič   (Slovenian), Josep Casadevall   (Andorran), substitute judges,   and also Michele de Salvia , Registrar .   Representatives of the parties   Government : Fokion Georgakopoulos , Agent , Vassilia Pelekou , Counsel.   Applicant : G. Zacharopoulos, H. Tagaras , Counsel.   After the hearing the Court will begin its deliberations, which are held in private. Judgment will be delivered at a later date.     Subject to his duty of discretion, the Registrar is responsible under the Rules of Court for replying to requests for information concerning the work of the Court, and in particular to enquiries from the press.   Registry of the European Court of Human F - 67075 Strasbourg Cedex Contact : Mr Roderick Liddell Telephone : (0) 3 88 41 24 92; fax : (0) 3 88 41 27 91    Citations
