FRANCE   Wednesday, 21 April 1999 at 9 a.m.   The applicant     The case concerns an application (application no.   29340/95) brought by a French national, Daniel Civet, who was born in 1947 and is currently in prison in Aiguebelle.   Summary of the facts     The applicant, who was the subject of a criminal investigation into allegations that he had committed a number of rapes, was charged and remanded in custody on 7 October 1993 by an investigating judge of Saint-Etienne tribunal de grande instance . From May 1994, the applicant submitted a number of applications for release, which were all dismissed by the investigating judge and the Indictment Division of the Lyons Court of Appeal. On 4 October 1994 the Court of Cassation struck out his sole appeal on points of law against a judgment upholding the dismissal of his application for release. On 27 June 1996 the applicant was sentenced to ten years’ imprisonment by the Assize Court of the Loire département .   Complaints     The applicant complains of the length of his detention on remand. He relies on Article 5 § 3 of the European Convention on Human Rights (the right to be brought to trial within a reasonable time).   Procedure     The application was lodged with the European Commission of Human Rights on 17 March 1995. Having found the application admissible, the Commission adopted a report on 16 April 1998 in which it expressed the opinion that there had been a violation of Article 5 § 3 (twelve votes to three). The case was brought before the Court by the French Government on 19 June 1998.   Composition of the Court     Under the transitional provisions of Protocol No. 11 to the Convention, the case was transmitted to the Grand Chamber of the European Court of Human Rights on the entry into force of the Protocol, on 1 November 1998.
