BELGIUM     Wednesday, 2 June 1999 at 2.30 p.m.     The applicant     The case concerns an application (application no. 26780/95)   brought by a French national, Alain Escoubet, who was born in 1948 and lives in Brussels.   Summary of the facts     Following a road accident on 16 June 1994, the Brussels Crown prosecutor ordered the applicant’s driving licence to be immediately withdrawn. On 21 June 1994 the applicant requested the return of his driving licence, which he had handed to the police on 17 June 1994. The public prosecutor granted his request on 23 June 1994.   Complaint     The applicant complains that, in breach of Article 6 § 1 and Article 13 of the European Convention on Human Rights, he did not have access to a tribunal to complain of the immediate withdrawal of his driving licence.   Procedure     The application was lodged with the European Commission of Human Rights on 12   September 1994. Having declared the application partly admissible, the Commission adopted a report on 12 March 1998 in which it expressed the opinion that there had been no violation of Article 6 § 1 of the Convention (eighteen votes to three) as that Article was inapplicable to the case. It referred the case to the Court on 3 November 1998.   Composition of the Court     Under the transitional provisions of Protocol No. 11 to the Convention, the case was transmitted to the Grand Chamber of the European Court of Human Rights on the entry into force of the Protocol, on 1 November 1998.
