THE NETHERLANDS   Tuesday, 6 June 2000 at 9.30 a.m.     The applicants   The case concerns an application brought by two Dutch nationals, Eveline Camp and Sofian Bourimi, who were born in 1966 and 1992 respectively and live in Weert, the Netherlands.   Summary of the facts   Eveline Camp was pregnant with Sofian and living in the Netherlands with Sofian’s father, Mr A. Bourimi, a Moroccan national, when he died on 24 September 1992. He left no will and his parents inherited and moved into the house. Ms Camp complained through the Dutch Courts and on 4 June 1996 the Court of Appeal struck out the case after an agreement was reached under which Ms Camp would leave the house with Sofian.   Complaints   The applicants complain about the fact that the ties between Sofian and his father and the latter’s relatives were not legally recognised until Sofian had been declared officially legitimate some time after his father’s death. Sofian was not recognised as the heir to his father’s estate, which included the home where he and his mother had been living. The applicants invoke Articles 8 (right to respect for family life and home) and 14 (prohibition of discrimination) of the European Convention on Human Rights.   Procedure   The application was lodged with the European Commission of Human Rights on 18   August   1995. Having declared the application admissible, the Commission adopted a report on 23 April 1999 in which it expressed the unanimous opinion that there had been no violation of Article 8 of the Convention, taken alone, either in respect of the family life between the two applicants or in respect of the first applicant’s family life with the relatives of the second applicant’s father, that it was not necessary to examine under Article 8 of the Convention, taken alone, the second applicant’s complaints relating to family life with the relatives of his father, and that there had been a violation of Article 14 of the Convention, taken together with Article 8, in respect of the second applicant. It referred the case to the Court on 15 September 1999.
