Ireland   Thursday, 12 October 2000 at 9.30 a.m.   The applicant   The case concerns an application brought by an Irish national, Sean Croke, who was born in 1956 and lives in Dublin.   Summary of the facts   Mr Croke’s case concerns his involuntary detention from July 1994 to July 2000 in a psychiatric hospital. In July 1995 he successfully challenged the constitutionality of Section 172 of the Mental Health Act 1945, pursuant to which he had been detained. However, in July 1996, the Supreme Court overturned the decision.   Complaints and submissions   Mr Croke’s case raises issues mainly under Article 5 (right to liberty and security) of the European Convention on Human Rights. He complains about the absence of an automatic and independent review of his detention both immediately before or after his initial detention and periodically during his detention.   He submits that he has never had a review, either on his initial detention or thereafter, which provided judicial supervision of the lawfulness of his detention appropriate to the kind of deprivation of liberty in question in accordance with Article 5 § 4 of the Convention.   The Government maintain that the applicant’s detention was lawful and not arbitrary and that he has available to him two categories of proceedings which, either individually or collectively, satisfy the review requirements of Article 5 § 4.   Procedure   The application was lodged with the European Commission of Human Rights on 11 September 1996.
