SWEDEN   Tuesday 26 September 2000 at 9.30 a.m.     The applicant   The case concerns an application brought by a Swedish national, Velimir Janosevic, who was born in 1964 and lives in Huddinge, Sweden. He is a taxi driver.   Summary of the facts   The applicant owned a taxi business and was ordered to pay additional taxes. As the information he had submitted in his tax returns was found to be incorrect, he was also ordered to pay tax supplements.   The total amount, more than 1   million Swedish kronor, was payable between February and April 1996.   Mr Janosevic disputed the tax authorities’ assessments and their decision to impose additional taxes. The question is still pending before the County Administrative Court.   Since the amount claimed was substantial, due immediately and since he disputed his obligation to pay, the applicant requested a stay in the payment pending the resolution of the   case.   This was refused, as he was unable to provide a banker’s guarantee as security.   The refusal was upheld by the County Administrative Court and the Administrative Court of Appeal.   Leave to appeal to the Supreme Administrative Court was refused.   As he was unable to pay the alleged outstanding tax debts, Mr Janosevic was declared bankrupt by the District Court on 10 June 1996.   On 30 October 1997 he was sentenced to 10   months’ imprisonment for certain tax and bookkeeping offences.   The judgment was upheld on appeal on 16 November   1998.   Leave to appeal to the Supreme Court was refused on 4 March 1999.   Complaints   The applicant claims that it was contrary to Article 6 (right to a fair trial) of the European Convention on Human Rights to enforce the decision of the tax authorities before a final court judgment had established his liabilities. He also complains that the tax proceedings have not been concluded within a reasonable time in breach of Article 6. Procedure   The application was lodged with the European Commission of Human Rights on 28 November 1996.
