ITALY   Tuesday 7 March 2000, at 2.30 p.m.     The applicant   Massimiliano Mattoccia is an Italian citizen born in 1964 and resident in Giulianello (Latina, Italy).   Summary of the facts   On 12 June 1990, at a time when he was working as a bus driver for a school for handicapped children in Rome, he was convicted of raping R., a mentally handicapped girl born in 1964. He was sentenced to three year’s imprisonment.   Complaints   The applicant complains under Article 6 of the European Convention on Human Rights that his trial was unfair because he was not informed in detail of the charges brought against him and because, he claims, the judges incorrectly assessed the evidence against him and refused to hear a witness on his behalf. He also complains under Article 6 § 1 of the Convention about the excessive length of the proceedings, which lasted approximately seven years and five months.   Procedure   The application was lodged with the European Commission of Human Rights on 22 May 1993. Having declared the application   partly admissible, the Commission adopted a report on 17 September 1998 in which it expressed the unanimous opinion that there had been a violation of Article 6 § 1 of the Convention as regards the length of the proceedings and by twenty-five votes to seven that there had been a violation of Article 6 §§ 1 and 3 of the Convention.
