GREECE   Thursday 19 October 2000 at 9 a.m.   The applicants   The applicants, all Greek nationals, are: Michael Pialopopoulos, born in 1951 and living in Pefki in Attika; Aristophanes Alexiou, born in 1930 living in Filothei in Attika; Nikolaos Georgakopoulos, the first applicant’s stepbrother, born in 1964 and living in Athens and Aristea Pialopopoulos, the first applicant’s sister, born in 1949 and living in Geneva.   Summary of the facts   The application concerns a series of building prohibitions and attempted expropriations (allegedly to protect the environment) as a result of which the applicants have been unable to use their property since 1987 and the alleged failure of the authorities to comply with a court decision revoking one of the expropriations.   Complaints   The applicants complain that their land has been expropriated contrary to Article 1 of Protocol No. 1 (protection of property) to the European Convention on Human Rights. They submit that it has not been substantiated that the expropriation was in the public interest and that there is no fair balance between the act of interference and the legitimate aim pursued. Moreover, domestic law has been violated since the authorities refuse to comply with court judgments and to pay the applicants prior compensation as provided for under the Greek Constitution.   The applicants also complain under Articles 6 § 1 (right to a fair trial) and 13 (right to an effective remedy) of the Convention that they do not have an effective remedy, because that they cannot enforce the court decisions in their favour.   Procedure   The application was lodged with the European Commission of Human Rights on 7   March 1997 and transmitted to the European Court of Human Rights on 1 November 1998. It was declared admissible on 15   June 1999.   Composition of the Court   The case will be heard by a Chamber composed as follows:   András Baka (Hungarian), President , Christos Rozakis (Greek), Viera Strážnická (Slovakian), Peer Lorenzen (Danish), Marc Fischbach (Luxemburger), Egils Levits (Latvian), substitute judges , Anatoly Kovler (Russian), judges ,   and also Erik Fribergh , Section Registrar .     Representatives of the parties   Government:   Phokion Georgakopoulos , Agent ,   Kyriaki Grigoriou ,   Stavros Spyropoulos, Advisers ;   Applicants:   Panayotis Bernitsas , Counsel .   ***   After the hearing the Court will begin its deliberations, which are held in private. Judgment will be delivered at a later date.   Registry of the European Court of Human Rights F – 67075 Strasbourg Cedex Contacts:   Roderick Liddell (telephone: (0)3 88 41 24 92)   Emma Hellyer (telephone: (0)3 90 21 42 15) Fax: (0)3 88 41 27 91   The European Court of Human Rights was set up in Strasbourg in 1959 to deal with alleged violations of the 1950 European Convention on Human Rights. On 1 November 1998 a full-time Court was established, replacing the original two-tier system of a part-time Commission and Court.Citations
