THE NETHERLANDS   Tuesday 24 October   2000 at 9.30 a.m.   The applicant   The case concerns an application brought by a Dutch national, Joseph Zander, who was born in 1952 and lives in Deventer (the Netherlands).   Summary of the facts   The applicant, Joseph Zander, had a relationship with B., out of which a child, Rosa, was born on 11 October 1987.   When their relationship ended, B.   applied for guardianship ( voogdij ) of Rosa. On 8   February 1991, the Deventer District Court apppointed B. as Rosa’s guardian ( voogd ) and the applicant as subsidiary guardian ( toeziend voogd ).   Rosa was to remain with B.   The applicant was granted access ( omgangsregeling ) under which Rosa would stay with him for one weekend each fortnight and for periods of several days during the school holidays.   On 11 May 1992 the Zutphen Regional Court agreed to change the access arrangement in accordance with the wishes of B. Under the changed arrangement the applicant was precluded from picking up or dropping Rosa at school.   Following an incident on 13 September 1992, B. refused the applicant all access to Rosa. The applicant tried unsuccessfully to oblige B. to recommence implementing the access arrangement.   His appeals to the Court of Appeal and Supreme Court failed.   On 9 June 1994 the Regional Court terminated the access arrangements as not being in Rosa’s best interests. The applicant appealed unsuccessfully.     Complaints   The applicant complains, firstly,   about the termination of the access arrangements between himself and Rosa and, secondly, that the Netherlands judiciary failed to enforce the arrangements before they were terminated.   He relies on Article 8 (right to respect for family life) of the European Convention on Human Rights.   Procedure   The application was lodged with the European Commission of Human Rights on 20 March 1996. Following the entry into force of Protocol No. 11 to the Convention on 1   November 1998, the case fell to be examined by the Court in accordance with the provisions of that Protocol.   Composition of the Court   The case will be heard by a Chamber composed as follows:   Elisabeth Palm (Swedish), President , Wilhelmina Thomassen (Dutch), Luigi Ferrari Bravo [1] (Italian), Corneliu Bîrsan (Romanian), Josep Casadevall (Andorran), Boštjan Zupančič (Slovenian), Tudor Panţîru (Moldovan), judges , Gaukur Jörundsson (Icelandic), Riza Türmen (Turkish), substitute judges ,   and also Michael O’Boyle , Section Registrar .   Representatives of the parties   Government:     Ms J.
