GREECE   Thursday, 18 January 2001 at 9 a.m.   The applicant   The case concerns an application brought by a Greek national, Eleni Malama, who was born in 1943 and lives in Athens.   Summary of the facts   This case concerns the expropriation of 942,250 square metres of land by the Greek State in 1923. The proceedings concerning compensation began in 1928 and continued until 1958, but without any final judgment. They were revived in 1963 by the applicant’s mother and aunt and ended with a judgment of the Court of Cassation on 18 June 1996. On 12 September 1997 the Athens Court of First Instance declared that the applicant was entitled to 3/8 of the compensation assessed by the Greek courts. However, the national authorities delayed in making payment. On 21 April 1999 the compensation as assessed by a court of appeal in 1993 was paid into the applicant’s bank account.   Complaints   The complaints made by the applicant when the application was lodged related to the national authorities’ refusal to comply with the judgments of the Greek courts fixing the compensation payable for the expropriation. Relying on Article 6 § 1 (right to a fair trial) of the European Convention on Human Rights and Article 1 of Protocol No. 1 (protection of property), the applicant complained that the Greek State’s refusal to pay her the compensation due had infringed her right to effective judicial protection with regard to civil disputes and her right to peaceful enjoyment of her possessions. She also complained of the length of the proceedings under Article 6 § 1. Following the payment of the compensation in April 1999 the applicant complains that the sum she received amounts to only 1.53% of the current value of the expropriated land.   Procedure   The application was lodged on 15 September 1998 and declared admissible on 25 November 1999.   Composition of the Court   The case will be heard by a Chamber composed as follows:   András Baka (Hungarian), President , Christos Rozakis (Greek), Giovanni Bonello (Maltese), Viera Strážnická (Slovakian), Peer Lorenzen (Danish), Marc Fischbach (Luxemburger), Anatoly Kovler (Russian), judges , Margarita Tsatsa-Nikolovska (FYROMacedonia), Egils Levits (Latvian), substitute judges ,   and also Erik Fribergh , Section Registrar .   Representatives of the parties   Government:   Phokion Georgakopoulos , Agent , Kyriaki Grigoriou , Counsel ,   Applicant:   Nicolaos Alivizatos, Eleoussa Kioussopoulou and Panayotis Voyatzis ,   Counsel .     After the hearing the Court will begin its deliberations, which are held in private.
