TURKEY     Tuesday 12 June 2001 at 9.30 a.m.     The applicants   The case concerns twenty-three applications lodged by forty-one members of the Turkish armed forces ordered to take compulsory early retirement. Their names are listed in the appendix.   Summary of the facts   By decisions of the Supreme Military Council taken between 11 December 1995 and 1 August 1997 the applicants were ordered to take compulsory early retirement “for breaches of discipline and scandalous conduct”. The applicants consider that their compulsory early retirement constitutes a sanction based on their religious beliefs (or in one applicant’s case on his political opinions). However, under Article 125 of the Turkish Constitution, decisions of the Supreme Military Council are not subject to judicial review.   Complaint[s]   The applicants complained of violations of Article 6 (right to a fair trial), 7 (no punishment without law), 8 (right to respect for private life), 9 (freedom of thought, conscience and religion), 10 (freedom of expression), 13 (right to an effective remedy) and 14 (prohibition of discrimination) of the European Convention on Human Rights.   Procedure   The applications were lodged with the European Commission of Human Rights on the dates shown in the appendix.
