THE NETHERLANDS AND LORSÉ v. THE NETHERLANDS   Tuesday 3 April 2001 at 9.30 a.m.   The applicants   The case concerns two applications brought by two Dutch nationals, Franciscus Cornelis Van der Ven and Jacobus Lorsé, who were born respectively in 1949 and 1945 and are currently detained in the Netherlands. In Lorsé v. the Netherlands , there are a further eight applicants, Mr Lorsé’s wife, Everdina Lorsé-Quint, born in 1961; and his seven children, Pieternella Johanna, Paula Martina, Jacobus (Junior), Johanna Maria, Neeltje Maria and Hubertus Joseph Lorsé and Maria Petronella Van Esch born, respectively in 1985, 1987, 1992, 1966, 1968, 1970 and 1965. They are all resident in Roosendaal, with the exception of the ninth applicant who resides in Rotterdam.   Summary of the facts   Since 29 October 1997 Mr Van der Ven has been detained on remand, charged with offences including murder and rape, in the Extra Security Institution ( Extra Beveiligde Inrichting , “EBI”), a maximum-security penal institution which is part of the Nieuw Vosseveld Penitentiary Complex in Vught (the Netherlands). Mr Lorsé, who is serving a 15-year sentence for drugs and firearms offences, was detained in the EBI from 27 September 1994 until 15 January 2001. The EBI regime was considered by the European Committee for the Prevention of Torture and Inhuman and Degrading Treatment or Punishment (CPT) to amount to “inhuman treatment”, characterised by excessive severity resulting in an insufficiency of privacy and human contact, leading to the deterioration of prisoners’ psychological and physical condition. Both applicants have unsuccessfully challenged their detention in the EBI.   Complaints   The applicants rely on Article 3 (prohibition of inhuman or degrading treatment or punishment), Article 8 (right to respect for private and family life) and Article 6 (right to a fair hearing) of the European Convention on Human Rights.   Procedure   Mr Van der Ven lodged his application on 30 August 1999.
