Requests by Senator Lines GmbH for payment of the fine to be suspended pending the outcome of the appeal were rejected by the CFI on 21   July 1999 and by the Court of Justice on 14 December 1999. The European Commission later obtained an enforcement order ( Vollstreckungsklausel ) in Germany, but stated that it would not enforce the fine while proceedings at the European Court of Human Rights were pending.   Before the European Court of Human Rights, Senator Lines GmbH alleged a violation of Article 6 (access to court) of the European Convention on Human Rights, in that it was required to pay the fine before a decision was taken in the substantive proceedings before the Court of Justice. Since 1 November 1998 it has sat as a full-time Court composed of an equal number of judges to that of the States party to the Convention. The Court examines the admissibility and merits of applications submitted to it. It sits in Chambers of 7 judges or, in exceptional cases, as a Grand Chamber of 17 judges. The Committee of Ministers of the Council of Europe supervises the execution of the Court’s judgments.
