His request to see his lawyer or his family was rejected.     On 4 July 1996 the applicant was brought before the Ankara State Security Court which ordered his detention on remand.

In particular, the police officers twisted his arms, hit him on the chest, stomach and groin. They also held him face-up on a desk with the applicant’s legs hanging down.

At the material time he was very weak and physically incapable of resisting his arrest. In spite of this, the masked officers forced him face-down to the ground, handcuffed him and beat him severely.

Throughout that period, the applicant had made no attempt to have access to his son and to resume contact with him.

The applicant submitted that during his arrest, O.Ž. had pulled him out of the car by his hand, had pulled his hands behind his back and had pushed him to the ground.
