On 5 March 1991 the competent public prosecutor at Königstein applied for a search warrant concerning the office of a notary at the Königstein District Court.

The applicant subsequently failed to attend a hearing in his case in February 1993 and, as he did not submit the medical certificate requested by the court within the specified time limit, an arrest warrant

No arrest warrant was issued against him. In a statement of November 1995 the applicant lodged an appeal on points of law.

case, as submitted by the applicant, may be summarised as follows: On 28 March 1997 the investigating judge ( Untersuchungsrichter ) at the Wiener Neustadt Regional Court ( Landesgericht ) issued a warrant

       On 16 June 1982 the applicant was arrested pursuant to a warrant of arrest issued by the Venezia Public Prosecutor on charges inter alia of belonging to a criminal organization

The European Court observed that the search, which had been carried out without a warrant and in the absence of impartial observers, had not respected the minimum guarantees the law imposed on the authorities

to respect for their private and family life in that on 21/10/1999, the police, mistakenly believing that an armed robber lived at their address, forced entry to search their home on the basis of a warrant

This judgment became final and an enforcement warrant was issued. On 24 October 2003 the applicant submitted the enforcement warrant to the Orhei Enforcement Department.
