Some of the men were armed with machineguns. 11 .     The men ordered everyone to get out of the car and show them their documents.

They consider that there is no need for them to exhaust domestic remedies as there were no effective remedies.   2.

The circumstances of the case The facts of the case, as submitted by the applicants and as they appear from the documents submitted by them, may be summarised as follows.

The men started running away and, when they failed to stop, the soldiers fired directly at them. The time by then was 1.30 a.m., according to the report.

The local authority accepts that they could foresee damage to the plaintiffs if they carried out their statutory duties negligently and that the relationship between the authority is sufficiently proximate

They were then sent to the prosecutor’s office where their release was ordered. 11.

There were differing versions of the events after the security forces had regained control, with the prisoners alleging that some of them had been ill-treated.

They then returned to police station no. 9, where the police officer on duty did not give them any further information, so they went home.

    The Government submitted that the applicants' house was not expropriated by the State but that they gave up their ownership in favour of the State of their own free will.

The court further left open whether an exception to this rule had to be made in exceptional cases in which there had been an extreme delay, as this was not the case in the proceedings against the applicants

The applicants stated that they had taken part in the first of these.

  If they had applied to the Supreme Administrative Court, they would undoubtedly have obtained the authorisation and no court would then have convicted them.

    The applicants then returned to the police, where they both gave statements.

Further, they claim that the principle of equality of arms had been violated in that the Schellenberg Municipality’s comments on their appeal were not communicated to them. 2.
