On the same day the applicant applied to the Enforcement Court for a second time, this time requesting his transfer to an 8 m² cell.

    Invoking Article 6 § 1 of the Convention the applicants allege that the length of the civil proceedings which lasted more than fifty years was excessive.

Accordingly, the proceedings lasted for six years and nine and half months.

The applicant was questioned on the same day.

The Court notes that the impugned judgment was quashed on 10   May   2000 and that the proceedings subsequently lasted until 19   December   2002.

The challenge was referred to the Riga Regional Court, which, with exactly the same members sitting and Mrs Šteinerte presiding, dismissed it.

On the same date the Santé Prison informed the applicant that although he was entitled to release for the offences for which he had been taken into custody on 15 February 1993 he would remain in custody
