    Under Article   41 of the Convention, the applicant in the first application was awarded just satisfaction in respect of non-pecuniary damage and his claim for pecuniary damage was rejected

Since there had been no formal expropriation and they had not been paid compensation the applicants issued proceedings for damages for the unlawful occupation of their land.
