According to the applicant company, its arguments were in line with the interpretation of the relevant limitation rules adopted by the Supreme Court of Ukraine (“the SCU”) in its ruling of 4 November 2014

It noted that, pursuant to the Code of Administrative Justice, an appeal on points of law could be lodged within a month from the date of the appellate court’s ruling.

On 13 May 2003 the Supreme Court rejected, as unsubstantiated, the applicant’s appeal in cassation against the latter ruling.

The   applicant challenged that ruling before the domestic courts, but without success.

Such temporary access was provided on the basis of a ruling of an investigating judge or a court (§   2).
